Washington Senate Bill 5197- Nonpayment Termination Rules 

Dear Members,

Under current law, Housing Providers must give Renters an Eviction Resolution Pilot Program (ERPP) Notice with any Notice to Pay or Vacate and send copies of both to the local Dispute Resolution Center (DRC).   

By statute, the DRC program ends July 1, 2023. This means that as of July 1, 2023, Housing Providers are no longer required to provide Renters with the ERPP Notice. However, Washington law still requires that a Housing Provider give a copy of the Notice to Pay or Vacate to the DRC. Pursuant to SB 5197, the requirement to send a copy of the Notice to Pay or Vacate to the DRC will end on July 23, 2023.

Please also remember that at any time, if you send a notice to pay or vacate that demands rent accrued between March 1, 2020, and April 30, 2023, you still must offer the Renter a Reasonable Repayment Plan.
